1. Introduction and Acceptance of Terms

Welcome to Recipe API ("Service," "we," "us," or "our").

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you (whether personally or on behalf of an entity, "you," "your," or "User") and Recipe API concerning your access to and use of the https://recipeapi.io/ website and all associated services, features, content, applications, and API (collectively, the "Service").

By accessing, browsing, or using the Service in any manner, including but not limited to visiting or browsing the website, registering for an account, or accessing the API, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Eligibility and Account Registration

2.1 Age Requirements

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract and meet all of the foregoing eligibility requirements. If you do not meet these requirements, you must not access or use the Service.

2.2 Account Registration

To access certain features of the Service, including the API, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process
  • Maintain and promptly update your account information to keep it accurate, current, and complete
  • Maintain the security and confidentiality of your API keys, passwords, and account credentials
  • Immediately notify us of any unauthorized use of your account or any other breach of security
  • Accept all responsibility for any activities that occur under your account

You are solely responsible for all activity occurring under your account. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

2.3 Business and Enterprise Accounts

If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, and "you" and "your" shall refer to such entity.

3. API Access and Use License

3.1 Grant of License

Subject to your compliance with these Terms, Recipe API grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the API and retrieve data for your intended purposes, including commercial use, in accordance with your subscription plan.

3.2 API Usage Restrictions

You agree that you will NOT:

  • Exceed the rate limits or request quotas associated with your subscription plan
  • Use the API in any manner that could damage, disable, overburden, or impair our servers or networks
  • Attempt to gain unauthorized access to the API, accounts, computer systems, or networks through hacking, password mining, or any other means
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the API or any underlying technology
  • Use the API to create a competing service or product
  • Redistribute, resell, or sublicense access to the API without our express written consent
  • Use the API in violation of any applicable law or regulation
  • Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices
  • Use the API to transmit any viruses, malware, or other harmful code

3.3 Commercial Use of API Data

Data retrieved through the API (accessible at https://recipeapi.io/api/) may be used for commercial purposes, subject to the following conditions:

  • You must comply with all applicable copyright laws and respect intellectual property rights
  • You must not represent that API data originated from you or misrepresent the source of the data
  • Attribution to Recipe API is appreciated but not required unless specified in your subscription plan

3.4 Website Content License

Content on the Recipe API website (excluding API data) is provided for informational purposes only. You may temporarily download one copy of materials for personal, non-commercial, transitory viewing only. You may not:

  • Modify, copy, or use such materials for commercial purposes
  • Use the materials for any public display without permission
  • Transfer materials to another person or mirror materials on any other server

4. Subscription Plans, Fees, and Payment Terms

4.1 Subscription Plans

Access to the API is provided through various subscription plans with different features, rate limits, and pricing. Details of available plans are available on our website and may be modified from time to time.

4.2 Free Trial

We may offer a free trial period for new users to evaluate the Service. Free trial terms, including duration and features, will be specified at the time of registration. At the end of the free trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial expires. No charges will be made during the free trial period.

4.3 Fees and Payment

  • All fees are quoted and payable in the currency specified on the website
  • Subscription fees are billed in advance on a recurring basis (monthly, annually, or as otherwise specified)
  • Payment is due immediately upon subscription or renewal
  • You authorize us to charge your designated payment method for all fees incurred

4.4 Refund Policy

We offer refunds under the following circumstances:

  • If you are dissatisfied with the Service, you may request a refund within 7 days of your initial subscription or renewal, provided you have not used the Service (no API calls made)
  • Refund requests must be submitted to hello@recipeapi.io with a brief explanation
  • We aim to review and respond to refund requests within 3-5 business days
  • Once approved, refunds are initiated immediately and typically take 5-10 business days to appear in your account, depending on your payment provider and bank
  • We reserve the right to deny refund requests that we determine, in our sole discretion, to be fraudulent or abusive
  • Fees paid for additional services, add-ons, or overage charges are non-refundable

4.5 Price Changes

We reserve the right to change our pricing at any time. Price changes will be communicated to you with at least 30 days' notice and will take effect at the start of your next billing cycle. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the modified amount.

4.6 Taxes

All fees are exclusive of applicable taxes (including VAT, sales tax, or other governmental taxes or fees). You are responsible for paying all applicable taxes associated with your use of the Service.

4.7 Failed Payments and Subscription Cancellation

If a payment fails, we will attempt to charge your payment method up to 4 times over a period of 2 weeks. If all payment attempts fail, your subscription will be automatically cancelled and your access to the Service will be suspended. You will be notified of failed payment attempts and can update your payment method to maintain service continuity.

4.8 Account Credits

In certain circumstances, such as when downgrading your subscription plan, you may receive account credits that are applied to your Recipe API account. The following terms apply to account credits:

  • Account credits are non-refundable and cannot be converted to cash
  • Credits will remain available in your account and can be used for future payments
  • When processing payments, account credits will be automatically applied and prioritized before charging your payment method
  • Credits have no expiration date and will remain usable as long as your account is active
  • Upon account termination, any remaining credits will be forfeited

5. Data Accuracy and Content Disclaimer

5.1 No Warranty of Accuracy

The Service provides recipe, ingredient, and nutritional data. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, reliability, or timeliness of any content provided through the Service.

5.2 Content Sources

Recipes, nutritional data, ingredient information, and other content accessible through the API are compiled and maintained by Recipe API. While we make every effort to ensure quality, variations may exist.

5.3 User Responsibility

You acknowledge and agree that:

  • You are solely responsible for evaluating the accuracy and reliability of content obtained through the Service
  • You should independently verify information before relying on it for any purpose
  • You assume all risks associated with your use of API data
  • You are responsible for ensuring compliance with copyright and intellectual property laws when using content obtained through the API

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service, including the API, website design, logos, software, technology, and all related intellectual property rights, are and remain the exclusive property of Recipe API and its licensors. These Terms do not grant you any rights to our trademarks, service marks, or logos.

6.2 Recipe Content

Recipe content, nutritional data, images, and related materials provided through the API are the property of Recipe API or used with appropriate permissions.

6.3 Feedback

If you provide us with any feedback, suggestions, or ideas regarding the Service, you grant us an unlimited, irrevocable, perpetual, royalty-free license to use such feedback for any purpose without compensation or attribution to you.

7. Prohibited Uses

You agree not to use the Service:

  • For any unlawful purpose or in violation of any applicable laws or regulations
  • To harass, abuse, threaten, defame, or otherwise violate the rights of others
  • To impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
  • To transmit spam, chain letters, or other unsolicited communications
  • To interfere with or disrupt the Service or servers or networks connected to the Service
  • To collect or store personal data about other users without their consent
  • To create a database by systematically downloading and storing all or substantial portions of API content for the purpose of creating a competing service, redistributing the data, or avoiding API usage limits. Reasonable caching of API responses for application performance is permitted.
  • In any manner that could disable, overburden, damage, or impair the Service
  • To engage in any activity that constitutes or encourages conduct that would constitute a criminal offense or give rise to civil liability

8. Term and Termination

8.1 Term

These Terms remain in effect while you use the Service or maintain an account with us.

8.2 Termination by You

You may terminate your account at any time by contacting us or using account management tools provided in the Service. Termination does not entitle you to a refund of any prepaid fees.

8.3 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Requests by law enforcement or government agencies
  • Technical or security issues
  • Discontinuation of the Service

8.4 Effect of Termination

Upon termination:

  • Your right to access and use the Service immediately ceases
  • You must cease all use of the API and destroy any downloaded materials
  • You remain liable for all fees incurred prior to termination
  • Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, limitations of liability, and dispute resolution provisions

9. Disclaimers and Limitation of Warranties

9.1 "AS IS" and "AS AVAILABLE" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 No Warranty

RECIPE API, ITS AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from use of the Service will be accurate or reliable
  • The quality of any content, products, services, information, or other material obtained through the Service will meet your expectations
  • Any errors in the Service will be corrected

9.3 Your Sole Risk

You acknowledge that your use of the Service is at your sole risk. No advice or information, whether oral or written, obtained by you from Recipe API or through the Service will create any warranty not expressly stated in these Terms.

9.4 Jurisdiction-Specific Rights

Some jurisdictions do not allow the exclusion of certain warranties or limitations on applicable statutory rights of a consumer. In such cases, the exclusions and limitations set forth in this section may not apply to you to the extent prohibited by applicable law.

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RECIPE API, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or use
  • Loss of business opportunity
  • System downtime
  • Cost of substitute services
  • Personal or property damage

This applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not we have been informed of the possibility of such damage.

10.2 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF:

(a) The total amount paid by you to Recipe API in the twelve (12) months preceding the claim; or (b) One hundred US dollars ($100 USD)

10.3 Essential Purpose

You acknowledge that the limitations of liability set forth in this section reflect a reasonable allocation of risk and that we would not provide the Service without these limitations.

10.4 Jurisdictional Limitations

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Recipe API, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party, including intellectual property rights
  • Your violation of any applicable law or regulation
  • Content you submit, post, or transmit through the Service
  • Any activity conducted under your account, whether authorized by you or not

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

12. Privacy and Data Protection

12.1 Privacy Policy

Your use of the Service is also governed by our Privacy Policy, available at https://recipeapi.io/legal/privacy-policy. Please review the Privacy Policy to understand our data collection, use, and disclosure practices.

12.2 Data Processing

By using the Service, you consent to the processing of your data in accordance with our Privacy Policy. If you are located in the European Economic Area, we process your personal data in accordance with the General Data Protection Regulation (GDPR).

12.3 Data Security

While we implement reasonable security measures to protect your information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.

13. Modifications to Terms and Service

13.1 Right to Modify

We reserve the right to modify these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of these Terms. While we may also provide notice through our website or by sending communications to registered users, we are not obligated to do so. It is your responsibility to review these Terms periodically for any changes.

13.2 Acceptance of Changes

Your continued use of the Service after any such modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and terminate your account.

13.3 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

14. Links to Third-Party Websites

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by Recipe API. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such third-party content, goods, or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

15.2 Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the courts located in Geneva, Switzerland. You irrevocably submit to the jurisdiction of such courts and waive any objection to venue or inconvenient forum.

15.3 Informal Resolution

Before filing a formal dispute, you agree to first contact us at hello@recipeapi.io and attempt to resolve the dispute informally. We commit to working with you in good faith to resolve any concerns.

15.4 Limitation Period

Any claim arising out of or related to these Terms or the Service must be filed within one (1) year after the cause of action arose. Claims filed after this period are permanently barred.

15.5 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. International Use and Export Compliance

The Service is operated from Switzerland and is available to users worldwide. We welcome users from all countries and jurisdictions.

By accessing and using the Service from outside Switzerland, you acknowledge and agree that:

  • You are responsible for compliance with all applicable local laws and regulations in your jurisdiction
  • You will comply with all applicable export control laws, trade sanctions, and regulations
  • You represent that you are not located in, under the control of, or a national or resident of any country subject to applicable trade embargoes or sanctions (including but not limited to countries designated by the United Nations, European Union, or Swiss government)
  • You will not use the Service in violation of any export restrictions or sanctions

If you are uncertain about whether your use of the Service complies with local laws, you should seek appropriate legal counsel before using the Service.

17. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

18. Miscellaneous Provisions

18.1 Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Recipe API regarding the Service and supersede all prior agreements and understandings.

18.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18.3 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

18.5 No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person other than you and Recipe API.

18.6 Survival

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution provisions.

18.7 Language

These Terms may be translated into other languages. In the event of any conflict between the English version and a translated version, the English version shall prevail.

18.8 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.
